These Terms & Conditions govern your use of this UP Music and Ultimate Performer website. By using the site, you agree to these terms. If you do not agree, please do not use the site.
1. Purpose of this site
This site provides general information about UP Music training, showcases, industry exposure, live performance opportunities, and related events. Site content is informational and is not itself an offer, talent contract, employment agreement, agency representation agreement, recording agreement, or guarantee of admission.
2. Eligibility and parent or guardian involvement
You must be legally able to agree to these terms. Anyone under 18 must use this site and participate in audition or program inquiries with the knowledge and involvement of a parent or legal guardian. A parent or guardian is responsible for reviewing program information and any separate enrollment documents for a minor.
3. Auditions, programs, and results
Submitting an inquiry, attending an audition, participating in training, or performing at an event does not guarantee selection, admission, representation, employment, professional work, a recording contract, a broadcast appearance, or career success. Industry professionals, mentors, venues, formats, schedules, and opportunities may change.
Any program price, payment schedule, cancellation term, release, code of conduct, or participation requirement will be provided separately when applicable. Those written program-specific terms control if they conflict with general information on this site.
4. Accurate information and acceptable use
You agree to provide accurate information and not to misuse the site. You may not attempt unauthorized access, interfere with site security, introduce malicious code, impersonate another person, scrape or reproduce site content unlawfully, or use the site in a way that harms performers, families, staff, or third parties.
5. Intellectual property
The site’s branding, logo, photography, graphics, copy, design, video, and other content are owned by or licensed to Ultimate Performer or UP Music and are protected by applicable intellectual-property laws. You may view the site for personal, noncommercial use. No other use is permitted without prior written authorization.
6. Third-party services and links
The site may link to registration providers, social platforms, venues, payment providers, or other third-party services. We do not control those services, and their terms and privacy policies apply to your use of them. A link does not imply a guarantee or endorsement of every third-party statement or service.
7. Availability and changes
We may update, suspend, restrict, or discontinue any part of the site or its content. We work to keep information accurate and available, but we do not promise that the site will always be uninterrupted, error-free, current, or suitable for every purpose.
8. Disclaimers and limitation of liability
To the fullest extent permitted by law, the site is provided “as is” and “as available,” without warranties of any kind. Ultimate Performer and UP Music will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the site. Nothing in these terms excludes liability that cannot legally be excluded.
9. Governing law
These terms are governed by applicable United States and Florida law, without regard to conflict-of-law principles, except where mandatory consumer-protection law in your location requires otherwise.
10. Changes to these terms
We may update these Terms & Conditions as the site, programs, or legal requirements change. The effective date at the top identifies the current version. Continued use after an update means you accept the revised terms.
